Citizenship cases

Section i) of paragraph (4), article 9. of the Fundamental Law of Hungary stipulates that the President of the Republic shall decide on all cases of acquisition and termination of citizenship. Please find hereunder information with respect to citizenship cases.

Rules pertaining to citizenship are set forth in Act LV of 1993 on Hungarian Citizenship (hereinafter Citizenship Act). The Budapest Municipal Government Office is predominantly responsible for preparing cases for a decision by the President of the Republic. The President of the Republic does not have the right of direct action on issues related to citizenship, the scope of the President’s mandate only covers citizenship issues and will decide in every case on the basis of a recommendation by the Minister of the Prime Minister’s Office.

Naturalization
A non-Hungarian citizen may request naturalization if:
- the person resided in Hungary continuously for a period of eight years;
- the person has a clean criminal record in Hungary, and at the time of the assessment of the application, there are no criminal proceedings in progress against the person before a Hungarian court;
- the person can submit proof that livelihood and residence are assured in Hungary;
- the person’s naturalization does not violate the public security and the national security of Hungary; and
- the person can submit proof of passing the examination in basic constitutional studies in the Hungarian language, or that of being exempted by virtue of this Act.

Preferential naturalization
After 5 years of continuous residence in Hungary a a non-Hungarian citizen may request naturalization on preferential terms, provided that the person
- was born in the territory of Hungary;
- had established residence in Hungary before reaching legal age;
- has a clean criminal record in Hungary, and at the time of the assessment of the application, there are no criminal proceedings in progress against the person before a Hungarian court;
- can submit proof that livelihood and residence are assured in Hungary;
- naturalization does not violate the public security and the national security of Hungary; and
- can submit proof of passing the examination in basic constitutional studies in the Hungarian language, or that of being exempted by virtue of this Act.

After 3 years of continuous residence in Hungary a a non-Hungarian citizen may request naturalization on preferential terms, provided that the person
- has lived in a valid marriage with a Hungarian citizen for at least three years, or the marriage has been terminated through the spouse’s death;
- the person’s minor child is a Hungarian citizen;
- the person has been adopted by a Hungarian citizen (an adult),
- the person has been recognized as a refugee by a Hungarian authority or is
- stateless if the person
- has a clean criminal record in Hungary, and at the time of the assessment of the application, there are no criminal proceedings in progress against the person before a Hungarian court;
- can submit proof that livelihood and residence are assured in Hungary;
- naturalization does not violate the public security and the national security of Hungary; and
- can submit proof of passing the examination in basic constitutional studies in the Hungarian language, or that of being exempted by virtue of this Act..

Preferential naturalization amy be granted to the minor non-Hungarian citizen, who was adopted by a Hungarian citizen, if this person
- has a clean criminal record in Hungary, and at the time of the assessment of the application, there are no criminal proceedings in progress against the person before a Hungarian court;
- if naturalization of this person does not violate the public security and the national security of Hungary.
