About the institution of the President of the Republic

The President of the Republic in international relations, participation in concluding international treaties
Based on section a) in paragraph (3) of Article 9. of the Fundamental Law, the President of the Republic represents Hungary. This provision refers to the representation of the Hungarian state in international law and complies with section a) of paragraph 2, article 7 of the Vienna Convention of 1969 on the Law of Treaties as well as with customary international law. The right of the President of the Republic to represent the Hungarian state is not dependent on co-signing, thus in accordance with Constitutional Court ruling 48/1991. (IX. 26.) AB it is part of the individual political decisions of the President of the Republic.

Pursuant to section a) of paragraph (4) article 9, the President of the Republic recognises the binding nature of international agreements by authorisation of the National Assembly.

Appointments, dismissals, nominations
Based on the Fundamental Law and relevant legislation, the President of the Republic has the authority to appoint and to dismiss numerous officials, while the nomination and proposal of the President of the Republic plays a role even when the appointment, election is not within his or her purview.

The National Assembly elects the Prime Minister on the recommendation of the President of the Republic. The President of the Republic acts on the recommendation of the Prime Minister to appoint and dismiss Ministers and State Secretaries.

Based on the recommendation of the President of the National Office of the Judiciary, the President of the Republic appoints and dismisses professional judges; decides on suspending the immunity of judges.

The Presidents of the Curia and the National Office of the Judiciary are elected by the National Assembly based on the nomination of the President of the Republic. The President of the Republic appoints the general vice-president and other vice presidents of the National Office of the Judiciary on the recommendation of the President of the National Office of the Judiciary, as well as the vice presidents of the Curia based on the recommendation of the President of the Curia.

The Supreme Prosecutor is elected by the National Assembly, on the recommendation of the President of the Republic, whereas the deputies are appointed by the President of the Republic on the recommendation of the Supreme Prosecutor.

The President of the Republic appoints the Chairman of the Budget Council.

Based on a recommendation from the Prime Minister, the President of the Republic appoints the Governor of the Hungarian National Bank (HNB) and the deputies, the President of the Hungarian Financial Supervisory Authority, the President of the Hungarian National Authority for Data Protection and Freedom of Information, the President of the Equal Treatment Authority, as well as the President of the Hungarian Competition Authority.
