About the institution of the President of the Republic

The President of the Hungarian Competition Authority will propose two candidates as deputies to the Prime Minister, who – if in agreement – will recommend them to the President of the Republic for appointment. The deputies are then appointed by the President of the Republic, who will immediately appoint one of them to serve as the Chair of the Competition Council. Other members of the Competition Council are appointed and dismissed by the President of the Republic on the recommendation of the President of the Hungarian Competition Authority.

The President of the Republic will propose the candidate for the office of the Commissioner for Fundamental Rights to the National Assembly.

University professors of state owned higher education institutions are appointed and dismissed by the President of the Republic based on the recommendation of the rector and the proposal of the Minister responsible for education affairs. In the case of private higher education institutions, the representative of the body maintaining the school shall recommend appointment – by way of the Minister – to the President of the Republic.

Rectors are appointed and dismissed by the President of the Republic from among the university professors, based on a decision of the Senate and upon the recommendation of the Minister. Proposals on the appointment and dismissal of rectors of privately run universities are proposed by the Minister responsible for education affairs to the President of the Republic based on a recommendation of the representative of the body maintaining the school.

The President of the Republic appoints and dismisses Ambassadors and Envoys on the basis of a recommendation of the Minister of Foreign Affairs.

The Head of State appoints and promotes generals based on the recommendation of the competent Minister.

The General Assembly – based on the nomination of Hungarian academics – elects the President of the Hungarian Academy of Sciences from its ranks; the President elect is then confirmed in his position by the President of the Republic.

The President of the Hungarian Academy of Arts (HAA) is elected for a period of three years by the HAA General Assembly from the ranks of ordinary members having Hungarian citizenship, who in turn is confirmed in his position by the President of the Republic.

Citizenship issues
Section i) paragraph (4) of Article 9. of the Fundamental Law stipulates that the President of the Republic will act on a proposal of the competent Minister and decide on any matters related to acquiring and terminating citizenship.

Presidential pardons
Section g) paragraph (4) of Article 9. of the Fundamental Law sets forth that the President of the Republic shall exercise the right of granting individual pardons on the basis of a recommendation coming from the Minister of Public Administration and Justice or from the Supreme Prosecutor.

Decisions related to territorial administration
The President of the Republic will, on the initiative of the local government concerned and the recommendation of the Minister of Public Administration and Justice decide on granting city titles, as well as the formation, unification or the dissolution of townships; on the name of the city and the township.

The President of the Republic is the Commander in Chief of the Hungarian Defence Forces
In accordance with paragraph (2) of Article 9. of the Fundamental Law, the President of the Republic shall be the Commander in Chief of the Hungarian Defence Forces. Act CXIII of 2011 on National Defence, the Hungarian Defence Forces and Measures That May Be Implemented in a State of Emergency as well as Resolution 48/1991. (IX. 26.) AB of the Constitutional Court will be applicable with respect to the tasks of the Commander in Chief and the constitutional exercise of responsibility.

Based on the above, the President of the Republic will, on the recommendation of the Minister of Defence approve the plans for the armed defence of the country; appoint and dismiss the Chief of the HDF Defence Staff, and assign and donate troop colours for the units, their higher commands and the superior bodies.

Mandate with respect to elections and referenda
Section e) paragraph (3) of Article 9. of the Fundamental Law sets forth that the President of the Republic will shall set a date for the general elections of Members of Parliament, local representatives and mayors, and of members of the European Parliament, and for national referenda.

Awarding decorations
According to section f) paragraph (4) of Article 9. of the Fundamental Law the President of the Republic awards statutory decorations, prizes and titles.

State decorations of Hungary are awarded by the President of the Republic based on the recommendation of the Prime Minister.
